24.153 – TO RECEIVE APOLOGIES FOR ABSENCE GIVEN IN ADVANCE OF THE MEETING
Apologies for absence had been received from Councillors Alan Catterick and David Johnson.
24.154- TO CONSIDER THE APPROVAL OF REASONS GIVEN FOR ABSENCE
Councillors Catterick and Johnson’s reasons for absence were approved.
24.155 – TO APPROVE THE MINUTES OF THE MEETING HELD ON 8 JULY 2024
The minutes of the meeting held on 8 July, having been circulated and read, were accepted and signed.
24.156 – TO RECEIVE THE CITY OF YORK COUNCILLOR’S REPORT – FOR INFORMATION ONLY
City Councillor Anne Hook said that she had nothing to report.
24.157 – PUBLIC PARTICIPATION
Three members of the public each gave a three-minute address with regards to planning application 23/01704/FUL.
One member of the public spoke about planning application 24/01282/HRN
24.158 – PLANNING APPLICATIONS
(a) The Councillors considered the planning applications received since the July Parish Council meeting as listed below: –
Details of Planning Application – Comments
Ref: 23/01704/FUL – Construction of 1no. dwelling on land to the rear of Model Farm following demolition of Nissen Huts and barn with associated access, landscaping and parking and restoration of existing pole barn at Model Farm House, The Green, YO26 6DP. Amendments
The Parish Council objects to the planning application on the following planning grounds
Policies:
The Village Design Statement talks of protecting “Penetrations of green and trees from adjacent agricultural land into the village core”
Policy NE8 in the Development Control Local Plan which talks of protecting the integrity of green corridors
Material considerations:
1. Impact on area: The development would negatively impact the area, encroach onto green land, the building height and bulk is increasing therefore will be more visible from the village green and there would be further unacceptable domestication of agricultural land.
2. Does it meet a housing need: It does not meet a housing need
3. Design / appearance: The design for the Nissen hut replacement is alien in style to the conservation area and heritage properties nearby and very large.
4. Green spaces: The green space would be negatively impacted – this development would result in further domestication of the green space.
5. Impact on community safety: There would be a negative impact on community safety. The proposed change of use of the Hay Barn into a Car Port will increase the number of vehicles on the farmstead and crossing the village green putting the vulnerable older people and children, who frequently use the green, at greater risk
6. Environmental issues: Domestication of green corridor will restrict access for wildlife into village and reduce wildlife habitats.
7. Heritage: The heritage value of this historic grade II listed farmstead in the Conservation Area should be protected. There is a cumulative effect from developing this historically significant farmstead and any further destruction should be resisted.
8. Access – The plan shows access and ownership across the green which is misleading as the parish council own this land on the village green on behalf of the village community.
The Parish Council rejects this plan. The previous plan was rejected because the design wasn’t compatible, for various reasons, with the Neighbourhood Plan, the new design is essentially unchanged and only reduced in size by 7m2..
Ref: 24/00804/FUL – Erection of 1no. detached dwelling to side at 13 Bankside Close, YO26 6LH. – Revision.
The Parish Council objects to the planning application on the following material considerations: –
1. Layout and density: The proposed new property is an example of overdevelopment. The plot is simply too small for a house of this design.
2. Loss of amenity: The proposed house will negatively impact the amenity value of the area, significantly changing the outlook for several properties around the development site, including loss of light for neighbouring properties.
3. Street scene: Building another house in this tight space will detrimentally alter the street scene and with that the ambience of the street.
4. Trees: There is also likely to be an impact on trees adjacent to the site.
5. Traffic: The road will struggle to accommodate the increase in vehicles associated with building this house. The proposed development is next to the turning circle at the end of the cul-de-sac which is often occupied by parked vehicles further congestion will place children at risk on their walking route to Poppleton Ousebank Primary School.
Ref: 24/01266/TPO – Crown reduce 1no. Oak by approximately 2m from the top and 2.5m from the sides – tree protected by Tree Preservation Order 1/1970 at 5 Bankside Close, YO26 6LH.
The Parish Council supports the planning application.
Ref: 24/01282/HRN – Removal of 829 metres of hedgerows at Land To The North Of Low Moor Fishing Pond, Low Moor Lane, Hessay.
The Parish Council objects as there is concern that the rate of loss of protected hedgerows in the village is against the Upper Poppleton Diversity Duty.
(b) To note Local Authority Planning Decisions
It was noted that the Local Planning Authority had approved the following applications: –
• Ref: 23/00823/FULM – Extension to warehouse (B8 Use with ancillary office/welfare space) with service yard, vehicular and cycle parking, and landscaping (resubmission) at Pavers Ltd, Catherine House, Northminster Business Park, Harwood Road.
• Ref: 24/00850/FUL – Variation of conditions 2 and 4 of permitted application 23/00742/FUL to amend the approved plans and elevations at Poppleton Community Centre, Main Street, YO26 6JT.
• Ref: 24/01102/FUL – 2no. single-storey rear extensions at 1 Ebor Way, YO26 6HJ.
It was noted that the Local Planning Authority had refused the following applications: –
• Ref: 24/00672/FUL – Raising of roofline to create additional storey with 4no. dormers and render to all elevations at Mill Race Bungalow, Main Street, YO26 6JX.
• Ref: 24/00819/ERC – Change of use from cafe (use class E) to 1no. dwellinghouse (use class C3) under The Town and Country Planning (General Permitted Development) Order 2015 (as amended) – Schedule 2, Part 3, Class MA at Poppleton Lakes, Boroughbridge Road, YO26 8JU.

Prior to the meeting the Clerk had emailed the internal auditor’s report to the Councillors. The contents of the report were noted.
(g) To receive the external auditor’s report
Prior to the meeting the Clerk had emailed the external auditor’s report to the Councillors. The contents of the report were noted.
24.160 – TO DISCUSS THE EXCESSIVE ADVERTISING MATERIAL OUTSIDE THE LORD COLLINGWOOD
It was agreed that the Clerk should write to the licensee of the Lord Collingwood to remind them that only one advertising board was allowed on the Green. (Action Clerk)
24.161 – TO CONSIDER MATTERS RELATING TO HIGHWAYS, FOOTPATHS, LAMPPOSTS & SIGNS
(a) Reports on vandalism
None.
24.162 – TO CONSIDER COUNCILLOR AND CLERK TRAINING
Details of YLCA courses are circulated to Councillors on a regular basis. It was agreed that none of the forthcoming courses were required.
24.163 TO DISCUSS THE PROGRESS IN CREATING ONE PARISH COUNCIL FOR POPPLETON
Councillor Lawrence updated the Parish Council on the latest developments. An email has been sent to all CYC councillors and to the relevant officials. The email included documents which were previously circulated to parish councillors.
The initial response from City officials is not helpful.
24.164 – TO RECEIVE COMMITTEES’ REPRESENTATIVES’ REPORTS
(a) Village Show
In Councillor Johnson’s absence there was no report on the Village Show which is being held on Saturday 17th August.
24.165 – TO RECEIVE A REPORT ON VILLAGE POLICING
Prior to the meeting the Clerk had forwarded the incidents reported to the police for July. The report was noted.
24.166 – TO RECEIVE THE CLERK’S REPORT ON PROGRESS ON THE FOLLOWING:
(a) The replacement of the “Vanstone” seat in front of the Methodist Chapel (Min. 24.146c)
The Clerk reported that the donor of the seat had paid for its cost and installation in full and that the seat had been ordered.
(b) The replacement of the “Selby” seat in front of the Methodist Chapel (Min. 24.146d)

24.167.1 – It was noted that the correspondence received since the July meeting, as listed below, had already been circulated to the Councillors.
(a) An email from the owner of Cherry Croft regarding amended plans for the property and offering Councillors open access to the gardens of the house. The Clerk is to write to the owner say that Councillors will take up the offer when the plans have been received (Action Clerk)
