MINUTES OF THE PARISH COUNCIL PLANNING MEETING HELD IN THE POPPLETON CENTRE, UPPER POPPLETON, AT 7.00PM ON MONDAY, 20 JANUARY 2025
PRESENT: – Cllr. E M Jones (Chairman), Cllrs. S P Barry, G R M Bates, R A Harper, J A Hook, C J Lamb and A G Walker. Also present were seven members of the public and the Clerk, Mr B J W Mackman.

The minutes of the Parish Council Planning meeting held on 18 November, having been circulated prior to the meeting, were approved and signed.

Ref: 24/01755/FUL – Conversion of redundant barns to form 2no. dwellings and erection of 1no. detached houses to rear with associated access and parking at Hills House, 18 Church Lane, YO26 6LB.
The Parish Council decision was B
Ref: 24/01864/FUL – Installation of an air source heat pump to front at 8 Poppleton Hall Gardens, YO26 6LE.
The Parish Council decision was B
Ref: 24/01921/FUL – Formation of mono-pitched roof to rear extension, rear canopy and alterations to rear fenestration at 3 Hutton Close, YO26 6PJ
The Parish Council decision was B
Ref: 24/02240/FUL – First floor front extension and conversion of detached garage to habitable space at 1 Midway Avenue, YO26 6NT.
The Parish Council decision was C. The following should be taken into consideration – THAT THE LIVEABLE SPACE PROVIDED BY THE CONVERSION OF THE GARAGE IS NOT FOR PERMANENT OVERNIGHT ACCOMMODATION BUT AN ADDITION TO THE GARDEN SPACE.,
Ref: 24/02319/FUL – Single-storey rear extensions, conversion of detached garage to habitable space, installation of solar panels to rear projection and erection of detached double carport and store to rear yard at 28 Church Lane, YO2 6LB.
The Parish Council decision was D based on the following planning considerations.
This is in a conservation area.
This proposal will have a high impact on other adjacent buildings which are in proximity.
This conversion of the garage to a liveable space will increase the traffic potential within the property
The requirement of a double carport to replace the garage is further backland development which is not supported by the neighbourhood plan. Parag 7.3 and 7.4
It is also in breach of PNP 6B Conversion of existing buildings to residential use. As they are proposing to build a carport to replace the garage this is contra to PNP6B.
This proposal is also in contravention of PNP6A where new development is encouraged it must not reduce the amenity of the building in place already.
It is also in breach of 2018 Local Plan Policy D4 Development proposals within or affecting the setting of a conservation area as this proposal will not preserve or enhance the special character and appearance of the conservation area.
It does not respect important views within the village.
While this building is not listed it does contribute significantly to the rural setting of the houses in Church Lane which were all formerly agricultural buildings or residences.
(b) To note Local Authority Planning Decisions
It was noted that the Local Planning Authority had approved the following applications –
• Ref: 24/01672/TCA – Fell 1no. (dead) Silver Birch – tree in a conservation at area 1 Poppleton Hall Gardens, YO26 6LE.
• Ref: 24/01921/FUL – Formation of mono-pitched roof to rear extension, rear canopy and alterations to rear fenestration at 3 Hutton Close, YO26 6PJ.
• Ref: – 24/01943/TCA – Fell 1no. Cypress (rear garden) – tree in a conservation area at 11 Church Lane, YO26 6LB.
It was noted that the Local Planning Authority had refused the following application –
• Ref: 21/01022/FUL – Variation of conditions 2 and 4 of permitted application 16/00093/FUL to allow the siting of one shepherds hut, construct drive-over waste point, erect replacement information hut and relocate gate, fence and CDP point at Caravan Site, Cherry Tree Cottage, Millfield Lane.
25/007 – TO RECEIVE A REPORT FROM THE LISTED BUILDINGS WORKING GROUP
Cllr Harper reported that he has still not had a response form Duncan Marks. It was noted that movement on the Local Historic List is a priority for the York Civic Trust. It is hoped therefore that some further developments will take place soon to move forward the proposal that the Parish Councils of Upper and Nether Poppleton have put forward for consideration.
